Terms of Service

Effective July 3, 2026

These terms govern use of Helmstay, an operations coordination service for short-term rental properties operated by Pagosa Tech Solutions, LLC ("Helmstay", "we", "us"), 2580 CR 917, Pagosa Springs, CO 81147, USA. By subscribing to Helmstay, or by participating in a property's Helmstay messaging as an enrolled staff member or guest, you agree to these terms. Our Privacy Policy describes how we handle information.

The service

Helmstay assigns a property a dedicated messaging line and coordinates the property's operations through it: turnover scheduling and confirmations, maintenance reports and dispatch, guest stay logistics, owner approvals, and operational summaries. Helmstay works inside messaging channels (SMS, WhatsApp, and similar), connects to the property's booking or property management system, and keeps the property's operational record.

Text messaging program terms

• By opting in as a property owner, being enrolled by a property owner as staff (with your consent), or messaging a property's Helmstay line as a guest, you consent to receive recurring operational text messages about that property.
• Consent to receive text messages is voluntary and is not a condition of purchasing or using any Helmstay service. Coordination is equally available over WhatsApp, email, or phone. Program details and online opt-in: helmstay.com/sms.
• Message frequency varies with property activity. Message and data rates may apply; carrier charges are the recipient's responsibility.
• Reply STOP to any message to opt out; you will receive a single confirmation and no further texts from that number. Reply HELP for help, or contact hello@helmstay.com.
• Carriers are not liable for delayed or undelivered messages.
• Helmstay is not an emergency service. Do not use it to report emergencies — call 911 or your local emergency number.

Subscriptions and responsibilities

Property owners must provide accurate information, keep their subscription and contact information current, and have the authority to connect their property's booking systems. When enrolling staff, the owner attests that each person has agreed to receive work-coordination messages. Owners are responsible for the instructions, templates, and approvals they configure and grant through the service.

Acceptable use

Property lines are for the operations of that property. You may not use Helmstay to send marketing or promotional content, spam, or unlawful, abusive, or deceptive messages, or to message people who have no connection to the property's operations. We may suspend or terminate service for those who violate these terms or carrier messaging policies.

AI-assisted messages

Some messages and summaries are drafted with AI assistance under templates and rules the property owner controls. Consequential actions — dispatching work, charging fees, changing calendar settings — require the owner's explicit approval before they happen. AI-drafted content can contain errors; owners should review the operational record and report issues to us.

Fees

Subscription fees are as published at helmstay.com or as agreed in writing, billed in advance, and non-refundable except where required by law. We may change pricing with notice effective at your next billing cycle.

Third-party services

Helmstay interoperates with third-party services — messaging carriers and platforms, booking and property management systems, payment processors. Their availability and terms are outside our control, and your use of them is governed by their own agreements.

Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that messages will be delivered, that suggestions will be error-free, or that the service will be uninterrupted. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the fees you paid us in the twelve months before the claim arose, and neither party is liable for indirect, incidental, or consequential damages.

Termination

You may cancel at any time, effective at the end of the current billing period. We may suspend or terminate the service for breach of these terms, carrier policy violations, or non-payment. Sections that by their nature survive termination (including payment obligations, disclaimers, and liability limits) survive.

Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Colorado.

Changes to these terms

If we make material changes, we will update this page and revise the effective date. Continued use of the service after a change means you accept the updated terms.
